We represent beneficiaries and successor fiduciaries in litigation involving trusts and estates. Often called probate litigation, these cases commonly involve complex asset tracing and require thoughtful and thorough investigation.

We have recovered millions of dollars on behalf of clients in cases involving negligence, breaches of fiduciary duty, and other wrongdoing by trustees, personal representatives, and other fiduciaries. We represent successor trustees and estate beneficiaries to challenge and unwind changes to a loved one’s estate plan by use of fraud or undue influence, or during a period when the loved one lacked capacity to change the estate plan. We help clients recover the value of trusts and estates that have been depleted through mismanagement, neglect, self-dealing, and embezzlement.

We also frequently represent trustees and personal representatives to pursue claims against debtors and tortfeasors. We have recovered millions of dollars for the benefit of trusts and estates in cases involving breaches of contract, legal malpractice, fraudulent transfers, and other claims.

We regularly co-counsel cases with estate planning attorneys who need our trial experience. We work with our clients and co-counsel to develop fee agreements—whether contingency fee, hourly fee, or a combination thereof—that fits the client’s objectives.
